ARTICLE 1 - SCOPE OF APPLICATION
These General Terms and Conditions of Sale (referred to as "GTC") are subject to the french law and apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("Customers or Customer"), wishing to purchase the products offered for sale ("Products") by the Seller on the oradiance.com website. The Products offered for sale on the website are as follows:
Range of luxury women's fashion products (clothings, bags, shoes, and accessories) from top luxury brands.
The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the oradiance.com website, which the customer is required to read before placing an order. The choice and purchase of a Product are the sole responsibility of the Customer. Product offers are understood to be within the limits of available stocks, as specified in the Article 3 - Order.
These GTC are accessible at any time on the oradiance.com website and shall prevail over any other document. The Customer declares that they have read these GTC and accepted them by ticking the box provided for this purpose before implementing the online ordering procedure on the oradiance.com website. Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The Products presented on the oradiance.com website are offered for sale for countries in the European Union. For all Products shipped outside the European Union and Overseas Departments and Territories, the price will be automatically calculated excluding taxes on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. They will be the responsibility and sole responsibility of the Customer.
ARTICLE 2 - PRICES
The Products are provided at the rates in force displayed on the oradiance.com website at the time of the order registration by the Seller. Prices of the Products are indicated in euros for Member States of the European Union, in US dollars for countries using said currency, or in the local legal currency of each respective country.
The rates take into account any discounts granted by the Seller on the oradiance.com website. These rates are firm and non-revisable during their validity period, but the Seller reserves the right, outside the validity period, to modify prices at any time.
Prices do not include processing, shipping, transportation, and delivery fees, which are charged in addition, under the conditions indicated on the website and calculated prior to placing the order. The payment requested from the Customer corresponds to the total amount of the purchase, including these fees. An invoice is established by the Seller and given to the Customer upon delivery of the ordered Products.
ARTICLE 3 – ORDERS
It is the responsibility of the Customer to select and order the Products they desire on the oradiance.com website, according to the following terms:
- Product offers are valid as long as they are visible on the website, within the limits of available stock. In the event of unavailability of an ordered Product, or if it is not possible to provide requested Products, a prompt notice shall be given to the User via e-mail, indicating the new expected time of delivery or the reasons that make the delivery not possible.
- If the User does not intend to accept the new term or the delivery has become impossible, he can request a refund of the amount paid, which shall be paid promptly with the payment method used for the purchase, within a maximum of 14 days from the date on which the Owner became aware of the refund request. Upon receipt of the Product, the User is required to verify its compliance with the order as well as the integrity of the packaging. In case of evident damage to the packaging and / or to the Product, the User can refuse the delivery of the Product and may return it without any charge.
- Once you have found the items you like, select the size using the Size Guide, then click 'Add to cart'. You can continue shopping by adding other items to your cart or proceed directly to the payment stage. The Cart summarizes the Products chosen by the Buyer as well as the prices and associated fees. The Buyer may freely modify the Cart before validating their order.
- The process for placing an order is simple and quick. You can either create an account or checkout as a guest. Regardless of the number of items in your cart or the number of brands, you only need to pay once.
- If the Buyer creates an Account, they must ensure the accuracy and completeness of the information provided. The Buyer is required to keep their personal information up to date. In the event of an error in the recipient's contact details, the Seller cannot be held responsible for the inability to deliver Products.
- To validate the order, the Buyer must accept these general terms and conditions of sales by clicking in the indicated place. They must also choose the address and finally validate the payment method.
- Order validation confirms the Buyer's acceptance of these general terms and conditions of sale, the Products purchased, their prices, and associated fees. Thus, any order placed on the oradiance.com website constitutes the formation of a distance contract between the Customer and the Seller.
- It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors.
- The sale will be considered final after the Seller sends the Buyer confirmation of the order acceptance by email, and after the Seller receives full payment. Your order will then be sent to you directly.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute related to the payment of a previous order. Once the Customer has an account, he could track the progress of their order on the website.
ARTICLE 4 - PAYMENT TERMS
The price is paid by secure payment, according to the following terms:
1. Cash payment by credit card
Payment can be made by the following credit cards: Carte Bleue, VISA, MASTERCARD, MAESTRO and American Express. The Customer is able to consult the General Terms and Conditions of Sale and Use of each of these credit cards on the websites of our partners. The choice of one of these payment cards constitutes tacit acceptance of the general terms and conditions of sale and use of said partners.
Online payment by credit card is perfectly secure and allows the confident entry of the card number, expiration date, and security code into the designated spaces. Indeed, credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never transit in clear text over the network. Payment is directly made to the bank. The oradiance.com website does not have access to these details and cannot store them on its servers. That is why they are requested again for each new transaction on our site.
2. Cash payment via the secure PayPal platform
Payments via PayPal are accepted on the oradiance.com website and are then made through the partner in question and according to their own general terms and conditions of sale and use of their services. The choice of this payment constitutes tacit acceptance of the general terms and conditions of sale and use of the Partner. We invite our customers to refer to them, as O’Radiance cannot be held responsible for the conditions set by these independent partners.
Payment data is exchanged in encrypted mode using the protocol defined by the authorized payment service provider involved in bank transactions carried out on the oradiance.com website.
Payments made by the Customer will only be considered final after effective collection by the Seller of the amounts due. The Seller will not be required to deliver the Products ordered by the Customer if the latter does not pay the full price in the conditions indicated above.
ARTICLE 5 - DELIVERIES AND FEES
Our online store ships products ordered by the Client in metropolitan France and worldwide with a few exceptions. We currently do not ship to Belarus, Russia and Ukraine.

Shipping fees vary based on the destination country. They are calculated at checkout and can be viewed in the order summary before payment.

Delivery Times :
International delivery times vary depending on the destination. Typical shipping windows range from 2-9 business days* to the address indicated by the Client at the time of the order on the website.
Delivery is defined by the transfer to the Client of physical possession or control of the Product. The Seller undertakes to make its best efforts to deliver the products ordered by the Client within the specified timeframes above.
* The estimated delivery times provided are for reference purposes only. While our top partner Retailers cannot assume liability for delays resulting from customs clearance or courier errors, we are committed to addressing any inconvenience and will ensure you receive regular updates regarding your shipment status. Please note also that during high-demand periods such as Black Friday, slight delivery delays may occur.
If the ordered Products have not been delivered within 30 days after the indicative delivery date, for any other reason than force majeure or the Client's actions, the sale may be terminated at the written request of the Client in accordance with the conditions provided for in articles L 216-2, L 216-3 and L241-4 of the Consumer Code. The sums paid by the Client will then be refunded to him no later than fourteen days following the date of denunciation of the contract, excluding any compensation or withholding.
Deliveries are ensured by an independent carrier, to the address mentioned by the Client during the order and to which the carrier can easily access. When the Client himself has taken care of calling on a carrier of his choice, delivery is deemed to have been made upon delivery of the Products ordered by the Seller to the carrier who accepted them without reservation. The Client therefore acknowledges that it is the carrier's responsibility to make the delivery and has no recourse against the Seller in case of non-delivery of the transported goods.
In the event of a specific request from the Client regarding the packaging or transport conditions of the ordered products, duly accepted in writing by the Seller, the related costs will be subject to specific additional billing, on a quote previously accepted in writing by the Client. The Client is responsible for checking the condition of the delivered products. He has a period of 7 days from the delivery to make claims by mail, email, accompanied by all supporting documents (including photos). After this period and failing to comply with these formalities, the Products will be deemed to be compliant and free from any apparent defect, and no claim will be validly accepted by the Seller. The Seller will refund or replace, at its own expense and as soon as possible, the delivered Products for which the defects of conformity or apparent or hidden defects have been duly proven by the Client, in accordance with the conditions provided for in articles L 217-4 and following of the Consumer Code and those provided for in these GTC.
The transfer of risks of loss and deterioration relating thereto will only be realized when the Client physically takes possession of the Products. The Products therefore travel at the Seller's risk, except when the Client has chosen the carrier himself. In this case, the risks are transferred at the time of delivery of the goods to the carrier.
ARTICLE 6 - TRANSFER OF OWNERSHIP
The transfer of ownership of the Products from the Seller to the Client shall only take place upon full payment of the price by the latter, regardless of the delivery date of said Products.
ARTICLE 7 - RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L221-18 of the Consumer Code, "For contracts providing for the regular delivery of goods over a defined period, the period shall run from receipt of the first goods." The right of withdrawal may be exercised online, using the attached withdrawal form also available on the website, or by any other unambiguous statement expressing the intention to withdraw, including by postal mail addressed to the Seller at the postal or email address indicated in ARTICLE 1 of the GTC.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be resold as new, accompanied by the purchase invoice. Damaged, soiled, or incomplete Products will not be accepted for return.
Return costs are the responsibility of the Client. Refunds will be made within 14 days of receipt by the Seller of the Products returned by the Client in accordance with the conditions set out in this article.
ARTICLE 8 - SELLER'S LIABILITY - WARRANTIES
The Products provided by the Seller benefit from:
- the legal guarantee of conformity, for defective, damaged, or non-compliant Products,
- the legal guarantee against hidden defects resulting from a defect in material, design, or manufacture affecting the delivered products and making them unfit for use,
Provisions relating to legal guarantees:
Article L217-4 of the Consumer Code "The seller is required to deliver goods that are in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when it was undertaken by the seller under the contract or was carried out under the seller's responsibility."
Article L217-5 of the Consumer Code "The goods comply with the contract:
1° If it is suitable for the purpose usually associated with such a good and applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in light of the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention, and accepted by the seller."
- Article L217-12 of the Consumer Code "The action resulting from lack of conformity shall be barred two years after delivery of the goods."
- Article 1641 of the Civil Code. "The seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them."
- Article 1648 paragraph 1 of the Civil Code "The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect."
To assert his rights, the Customer must inform the Seller, in writing (by email or letter), of the non-conformity of the Products or the existence of hidden defects from their discovery. The Seller will refund, replace, or repair the non-compliant or defective Products or parts under warranty. Shipping costs will be refunded based on the invoiced rate, and return costs will be refunded upon presentation of receipts. Refunds for non-compliant or defective Products will be made as soon as possible and no later than 14 days following the Seller's finding of non-compliance or hidden defect.
This refund may be made by bank transfer or check. The Seller's liability cannot be incurred in the following cases:
- non-compliance with the legislation of the country to which the products are delivered, which is the responsibility of the Customer to verify,
- in the event of misuse, professional use, negligence, or lack of maintenance by the Customer, as well as in the event of normal wear and tear of the Product, accident, or force majeure.
- The photographs and graphics presented on the site are not contractual and cannot engage the Seller's liability.
The Seller's warranty is, in any event, limited to the replacement or refund of non-compliant or defective Products.
ARTICLE 9 - PERSONAL DATA
The Customer is informed that the collection of their personal data is necessary for the sale of the Products by the Seller and for their transmission to third parties for the purpose of delivering the Products. This personal data is collected only for the execution of the sales contract.
9.1 Collection of personal data
When you interact with us, whether by using our Website or contacting us directly, the following data may be collected about you:
- Ordering Products
When ordering Products by the Customer: Names, first names, postal address, telephone number, and email address.
- Payment
As part of the payment for the Products offered on the oradiance.com website, it records financial data related to the Customer's/user's bank account or credit card (even if it is the payment processing companies that store them and not us).
9.2 Recipients of personal data
Personal data is used by the Seller and its co-contractors for the execution of the contract and to ensure the effectiveness of the sales and delivery service of the Products. The category(ies) of co-contractor(s) is (are):
- Transport service providers
- Payment establishments
9.3 Data Controller
The data controller is the Seller, within the meaning of the Data Protection Act and as of May 25, 2018, Regulation 2016/679 on the protection of personal data.
9.4 Limitation of processing
Unless the Customer expressly agrees, their personal data will not be used for advertising or marketing purposes.
9.5 Data retention period
The Seller will retain the data collected for a period of 5 years, covering the time of prescription of the applicable contractual civil liability.
9.6 Security and confidentiality
The Seller implements organizational, technical, software, and physical measures regarding digital security to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment, and the Seller cannot guarantee the security of the transmission or storage of information on the Internet.
9.7 Implementation of Customer and user rights
In accordance with the applicable personal data regulations, Customers and users of the oradiance.com website have the following rights:
- They can update or delete their data as follows:
Send a letter or an email to the data controller of the company (or to the data protection officer or, failing that, to customer service) to request the deletion of your personal data.
They can delete their account by writing to the email address indicated in article 9.3 "Data Controller".
- They can exercise their right of access to know the personal data concerning them by writing to the address indicated in article 9.3 "Data Controller".
- If the personal data held by the Seller is inaccurate, they can request the update of the information by writing to the address indicated in article 9.3 "Data Controller".
- They can request the deletion of their personal data in accordance with applicable data protection laws by writing to the address indicated in article 9.3 "Data Controller".
- They can also request the portability of the data held by the Seller to another service provider.
- Finally, they can object to the processing of their data by the Seller.
These rights, provided they do not conflict with the purpose of the processing, can be exercised by sending a request by mail or email to the Data Controller whose contact details are indicated above. The data controller must respond within a maximum period of one month. In case of refusal to comply with the Customer's request, it must be justified.
The Customer is informed that in case of refusal, they can lodge a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS) or contact a judicial authority. The Customer may be asked to check a box indicating their agreement to receive informational and advertising emails from the Seller. They will always have the option to withdraw their consent at any time by contacting the Seller (contact details above) or by following the unsubscribe link.
ARTICLE 10 - INTELLECTUAL PROPERTY
The content of the oradiance.com website is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and may constitute an act of counterfeiting.
ARTICLE 11 - APPLICABLE LAW - LANGUAGE
These General Terms and Conditions of Sale (GTC) and the operations arising from them are governed by and subject to French law. These Terms and Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
ARTICLE 12 - DISPUTES
For any claim, please contact the customer service at the postal or email address of the Seller indicated in ARTICLE 1 of these GTC.
Mediation The Client is informed that they may, in any case, resort to conventional mediation, through existing sectoral mediation bodies or any alternative dispute resolution method (conciliation, for example) in case of dispute.
